In a Pomona probate the house is ordinarily appraised for the court inventory by the probate referee, under California Probate Code section 8902. An estate also wants an independent report when the people handling it need to see the reasoning: the comparable sales, the condition on the date of death and each adjustment, written for named intended users such as the personal representative, the heirs, the attorney or the CPA. That report sits beside the referee's value; it does not replace it, and no one can know before the work is done how the two will compare.
Two appraisals, two jobs
The probate referee, a person appointed by the State Controller and designated by the court to appraise estate property, values the house for the inventory and appraisal, the document the personal representative files listing each estate asset at its fair market value at the time of death (sections 8800 and 8802). The personal representative, the executor or administrator the court appointed, delivers the inventory and supporting data to the referee. Probate Code 8900 in plain words sets out who appraises which property.
An independent residential appraisal is a different assignment. It states its intended use, what the report will be used for, and its intended users, the people entitled to rely on it. Its scope of work, the type and extent of research and analysis, is agreed at engagement: an interior inspection if the house is still accessible, records and photographs if it is not. Its effective date, the date the opinion of value applies to, is usually the date of death, which makes it a retrospective appraisal, one whose effective date is in the past.
Why Pomona estates order the second report
Pomona's housing is varied enough that a single figure on an inventory line can leave the family with questions only the analysis answers. These are the kinds of assignments that come in.
Houses in the historic districts
Lincoln Park, Wilton Heights and Hacienda Park hold single-family homes from the 1880s to the 1940s in late Victorian, Craftsman and revival styles. A restored house and an unrestored one two streets apart are not the same purchase, so the condition on the date of death decides which sales are comparable. District status is noted as a condition of the property, and comparables are chosen for era and style, as the historic and pre-1940 home appraisal page explains.
Older multi-family around downtown
Downtown and the blocks along Holt Avenue and toward the Fairplex hold duplexes, fourplexes and houses divided into units, where the legal unit count can differ from what the records show. A date-of-death report states the unit count it relied on, from permits and city records, and the rents in place on that date. Pomona's rent stabilization program and the state Tenant Protection Act are noted as conditions affecting income, not as legal advice. The two-to-four unit appraisal page covers the income approach.
Postwar tracts and Phillips Ranch
Across the postwar tracts, garage conversions and back units are the recurring questions, and the permit date decides whether the space counted as permitted living area on the date of death. Phillips Ranch, the later planned community in the southwest hills, adds slope, view and HOA terms as they stood on that date.
East Pomona at the county line
Pomona's eastern edge meets Montclair at the Mills Avenue line, and Montclair is in San Bernardino County. A Montclair sale is used for an east Pomona house only when it is genuinely better evidence, with the location difference explained. The Pomona area page describes these pockets in more detail.
What the independent report shows that an inventory line does not
- The comparable sales, all closed on or before the date of death, with the reason each was chosen.
- Condition as of that day, built from photographs, permits, invoices and a walkthrough today with later changes identified.
- Every adjustment, for gross living area, the finished above-grade living space, and for lot, condition, era and units.
- Any extraordinary assumption, an assumption about uncertain facts that, if false, could change the result, such as the condition of a kitchen remodeled after the death.
- Two dates: the effective date and the date of report, the day the report is signed.
Section 8908 also lets the personal representative or a beneficiary ask the referee for the appraisal report or backup data used for an item.
Objections, buyouts and basis: who decides
Section 8906 lets the personal representative or an interested person file a written objection to the appraisal before the hearing on final distribution, and the person objecting has the burden of proof. Whether to object is a decision for the estate's attorney; an independent report documents evidence and takes no side. The appraiser is independent of every party, including the one who pays.
For an heir buyout, siblings often want one report they can all read. For basis, IRS Publication 551 says inherited property generally takes its fair market value at the date of death, or on the alternate valuation date if the personal representative elects it; that reset is called stepped-up basis. Your CPA decides which value is used and how, and the stepped-up basis article lists what the CPA reads on the report. The county's assessed value is not an appraisal, and it does not answer any of these questions.
What to gather for a Pomona estate
- The date of death, the address, and whether the estate is in probate or the house was in a trust
- Who is ordering, and who else will read the report
- Photographs from around the date of death, and any listing photos
- Permits for additions, conversions or extra units, and leases for any rental units
- The referee's appraisal, if it has been received

Frequently asked questions
Who appraises a Pomona house in probate?
Ordinarily the probate referee designated by the court. California Probate Code section 8902 has the referee appraise all inventory property other than the cash-like items the personal representative values, and that includes real property.
Why would a Pomona estate order an independent appraisal as well?
To see the reasoning: the comparable sales that closed by the date of death, the condition on that day and each adjustment, written for named intended users. Estates use it to understand the value, to consider an objection with their attorney, for an heir buyout or for the CPA's basis work.
Does an independent appraisal replace the probate referee's value?
No. The referee's appraisal is the one in the court inventory unless the court waives the referee. An independent report is a separate assignment with its own intended use and users, and whether it is used in the probate is the attorney's decision.
How is a Pomona fourplex valued as of the date of death?
With comparable sales of small income property that closed by that date, the legal unit count from permits and city records, and the rents in place then. Pomona's rent stabilization program and the Tenant Protection Act are noted as conditions affecting income, not as legal advice.
Can the appraisal be done if the Pomona house has been cleared or repaired?
Yes. Condition on the date of death is rebuilt from photographs, permits, invoices and a walkthrough today. Any fact that cannot be confirmed is handled as an extraordinary assumption and stated plainly in the report.
